COWLEY COUNTY — An Arkansas City man is being held on a $52,000 bond after a series of violent confrontations on Monday that began with an alleged domestic assault and ended with an attempt to seize an officer’s firearm.
Kody Wayne Nuss, 42, was taken into custody following an investigation by the Arkansas City Police Department.
The Domestic Incident
According to police, the series of events began just before 3:30 a.m. on Monday. A 61-year-old woman fled to a neighbor’s home to seek help after she was allegedly strangled by her son, Nuss.
Authorities stated that during the altercation, Nuss reportedly broke the victim’s glasses and stole her cellphone, medication, and vehicle. He had fled the scene by the time officers arrived.
Arrest and Confrontation
Officers located the stolen vehicle at 6:32 a.m. that same day after receiving reports of erratic driving. The vehicle had struck a parked car, and officers encountered Nuss as he was exiting the vehicle.
While being taken into custody, police say Nuss became verbally combative and refused officer commands. Despite being handcuffed behind his back, Nuss allegedly attempted to grab an officer’s holstered firearm. Officers intervened immediately, utilizing force to prevent him from gaining control of the weapon and to secure him safely.
Upon searching the suspect, officers recovered the victim’s stolen property.
Investigation and Charges
During the arrest process, officers developed probable cause to investigate Nuss for driving under the influence (DUI). When Nuss refused to cooperate, officers obtained a search warrant for a blood sample. According to the police statement, officers used necessary force to execute the warrant and allow fire and EMS personnel to safely collect the sample.
Nuss is currently held in the Cowley County Jail on the following requested charges:
- Aggravated Domestic Battery
- Aggravated Robbery
- Aggravated Assault on a Law Enforcement Officer
- Interference with Law Enforcement
- Theft
- Criminal Damage to Property
- Possession of a Depressant
- Driving Under the Influence
The Cowley County Attorney’s Office is expected to file additional traffic-related charges as the investigation continues.
